The State Public Service Commission is a constitutional body. A State Public Service Commission exists in each state. Articles 315-323 of the Constitution go into more detail about the composition, appointment, and removal of members, as well as the power and functions of a State Public Service Commission and its independence. The State Public Service Commission's Authority and Functions

A State Public Service Commission performs all of the tasks that the UPSC does with respect to central services in relation to state services:

  • It is in charge of administering examinations for appointments to the state's services.
  • It is consulted on the following human resource management topics.
  • All concerns concerning civil service and civil post-recruiting.
  • The principles should be followed when appointing government servants and offices and promoting and transferring from one service to another.
  • A Public Service Commission should advise the President of India or the Governor of the State on any topic brought to them.
  • Concerning the promptness of decisions and the discipline of action in government activities, the payment of compensation to a government employee if the employee has incurred any troubles or financial loss due to the government's carelessness.
  • It also has the authority to deal with concerns concerning penalty measures for employees who have breached discipline and all matters concerning the interests of government employees working for the State government.

Members' eligibility and the appointment process:

  • The Governor of State appoints the Chairman and other members of the SPSC.
  • The Governor of State is authorized under the Indian Constitution to decide the terms of service for the Chairman and other State Public Service Commission members.
  • An SPSC member is elected for a six-year term or until 62, whichever comes first.
  • Any person who previously served on a Public Service Commission is ineligible for reappointment to that position.
  • The State Public Service Commissions members shall not have any profit-making positions in the federal or state governments.

Appointment of a chairman and an acting chairperson:

If any of the following conditions exist, the Governor may nominate one of the SPSC members as interim Chairman:

  • The position of commission chairperson becomes vacant;
  • The Chairman of the Commission cannot discharge the responsibilities of his office owing to absence or for any other cause.
  • The acting Chairman will perform the Chairman's responsibilities until the Chairman returns to its office.

Removal provisions include the following:

Article 317 states that the President has the authority to dismiss members of both public service commissions before their terms expire if any of the following four conditions exist:

  • A commission member declares bankruptcy (insolvent).
  • A member of the Commission undertakes any paid work outside official responsibilities.
  • The commission member gets psychologically or physically ill.
  • For misconduct on the part of a commission member.

In misbehavior, the Supreme Court investigates the problem; if the member is found guilty, the President can remove him/her from the Commission. In such cases, the Supreme Court's ruling is binding on the President.

During the period in which the Supreme Court is investigating the subject, the President has the authority to suspend members of the Union Public Service Commission. In the case of the State Public Service Commission, the Governor of the State has the authority to suspend the member.

Provisions Concerning Reporting:

Article 323 requires the State Public Service Commission to submit an annual performance report to the Governor.

When the Governor receives such a report, he must give it to both chambers of the legislature (if the legislature is bicameral), along with a note explaining why he did not adopt the Commission's suggestion.

Some Recent State Public Service Commission Issues

  • Recently, there have been reports of corruption in public service commission recruiting. The recent revelation of the VYAPAM fraud demonstrates malpractices in government job recruiting.
  • Politicians are frequently accused of attempting to tamper with the outcomes of public service tests.
  • Money power is also used to acquire a job in several instances.
  • Due to the occurrence of cases of corruption and malpractice, the recruiting process has been delayed and, on several occasions, terminated by the Courts.

Steps to improve system efficiency include the following:

  • Exams should be held at regular intervals, and results should be announced as quickly as practicable.
  • Efforts should be taken to limit government intervention in recruiting, and exams should be held on time.
  • To ensure that only qualified candidates take the test, fingerprints should be obtained both when the application is submitted and when the exam is administered.
  • Other service commissions can copy the UPSC's best practices to retain openness and confidence.

The Public Service Commissions are the fundamental framework that guarantees and defends the meritocracy of Indian government services. Its transparent and fair operation is critical to the country's democratic structure.
